1. Introduction

Welcome to Chromapeel ("Chromapeel," "Service," "we"). These Terms of Service ("Terms") govern your access to and use of our website at chromapeel.com and related products and services (collectively, the "Service").

By accessing or using the Service, you confirm you have read, understood, and agree to these Terms. If you do not agree, please do not use the Service.

These Terms should be read together with our Privacy Policy.

2. Eligibility & Accounts

2.1 Age Requirements

You must be at least 13 years old to use the Service.
If you are 13–18 (or the age of legal majority in your jurisdiction), you may use the Service only with the consent and supervision of a parent/guardian who agrees to be bound by these Terms.

When you create an account via third-party login (e.g., Google, GitHub, or other identity providers we may support), you agree to:

Provide truthful, accurate, and current account information
Use only accounts that belong to you
Remain responsible for all activity under your account
Promptly notify us of any unauthorized use or security issues ([email protected])

We may suspend or terminate accounts for violations, abuse, or security concerns.

3. Subscriptions & Billing

3.1 Plans

We offer free and paid subscriptions (e.g., Starter / Pro / Studio). Pricing, features, and allowances follow the latest details on our pricing page and may change over time.

3.2 Auto-Renewal & Charges

Paid plans bill monthly or annually and renew automatically unless canceled before renewal.
Charges are processed by our payment provider (e.g., Creem) using your chosen payment method.

3.3 Cancellation

You can cancel anytime via account settings or by contacting [email protected]:

After cancellation, you keep paid features until the current billing period ends.
Unused time in the current period is not refundable.
After the period ends, your account will revert to the Free plan (if retained).

3.4 Price & Plan Changes

We may adjust pricing or plan contents. Changes:

Apply immediately to new purchases or subscriptions
Typically take effect in the next billing cycle for existing subscribers

If a change materially affects your subscription, we will provide notice within a reasonable, feasible window. If you disagree, cancel before it takes effect.

3.5 Refund Policy

Unless required by law or explicitly promised by us:

Paid fees and issued credits are non-refundable and non-convertible.
In limited cases (e.g., severe technical faults, clear billing errors), we may, at our discretion, offer refunds or credits. This is not an obligation.

4. Credits

4.1 Allocation

Free plan: we may grant one-time trial credits on signup; the exact amount follows what is shown in the UI.
Paid plans: credits for the current period are issued at the start of each billing cycle; amounts follow the pricing page.

4.2 Usage & Expiration

Credits are consumed to generate images; different models/resolutions/features may cost different amounts (see UI).
Typically, credits are deducted only on successful generations; obvious failures may be auto-refunded or compensated.
Credits issued for a billing period are valid only in that period; they expire at period end and do not roll over.
Credits are non-refundable, non-convertible, and non-transferable between accounts.

4.3 Upgrades & Downgrades

Upgrade: usually takes effect immediately in the current period; we may adjust available credits accordingly (see UI at upgrade time).
Downgrade: usually takes effect at the start of the next period; current-period entitlements remain until then.

We may refine upgrade/downgrade rules as needed, with the UI as the source of truth.

5. Generated Content & Rights

5.1 Inputs

"Inputs" include prompts, reference images, files, and parameter settings you submit.

You retain the rights you hold in your Inputs.
You grant us a non-exclusive, worldwide, royalty-free license to process, store, and use Inputs as needed to provide the Service (including generation, logging, security/audit).
You are responsible for ensuring Inputs do not violate law or these Terms (see Section 6).

5.2 Outputs

"Outputs" are images or other results generated from your Inputs. Subject to law and these Terms:

Free accounts: Outputs may be used for personal, non-commercial purposes to test and experience the Service. Do not use Free outputs for any direct or indirect commercial purpose (e.g., ads, paid deliverables, product listings).
Paid subscriptions (e.g., Starter / Pro / Studio): During an active subscription, you receive a commercial use license to use Outputs in personal or commercial projects and retain long-term use in those projects, subject to Section 6 and applicable laws.

For all accounts:

You are responsible for ensuring your use of Outputs does not infringe IP, publicity, or other rights.
We do not assume liability for your use of Outputs and do not guarantee copyrightability or exclusivity of AI-generated content.

5.3 Our IP

You acknowledge:

The Service’s models, algorithms, software, UI, logos, brand assets, and related technology belong to us or our licensors.
Except as expressly granted, you obtain no ownership or license to our IP by using the Service.

5.4 Use Restrictions (Outputs)

Even on paid plans, you must not:

Claim “exclusive” or “sole” copyright over AI-generated images.
Package large volumes of minimally modified Outputs as a stock library or similar product whose primary value is the images themselves.
Use Outputs or data from the Service to train or improve any generative AI model or service that competes with the Service.

6. Prohibited Content & Activities

6.1 Prohibited Content

Illegal content or anything violating applicable law
Child sexual abuse material or content exploiting minors
Explicit pornography or excessively graphic sexual content
Extreme violence, torture, or gore
Hate speech; incitement to violence; discrimination or harassment based on protected characteristics
Deepfakes or misleading depictions of real people (including public figures) without consent, especially negative/defamatory/sexual content
Content infringing third-party IP, trademarks, copyrights, or other rights (e.g., making protected characters the primary commercial draw)
Malicious or harmful content (fraud, phishing, malware, security interference)

6.2 Prohibited Activities

Using the Service in violation of law or these Terms
Sharing or transferring your account to others
Circumventing or interfering with billing, quotas, rate limits, or security controls
Reverse engineering, decompiling, or attempting to extract our models, algorithms, or source code
Unauthorized automated scripts/bots for large-scale calls
Unauthorized access attempts to our systems, interfaces, or data
Using the Service to build materially similar or competing products

6.3 Consequences

If we reasonably believe you violated these Terms or law, we may:

Remove or block content
Restrict features
Suspend or permanently freeze your account
Terminate your access and subscription without refund of paid fees or remaining credits

For serious violations, we may report to platforms, payment providers, or authorities.

7. Availability & Storage

7.1 “As Is” Service

The Service is provided "AS IS" and "AS AVAILABLE." We do not guarantee:

Uninterrupted, error-free, or secure operation
Availability at all times, regions, or devices
Immediate fixes for all defects
That the Service meets every specific need or expectation

We provide no uptime guarantees or SLAs.

7.2 Maintenance & Changes

We may:

Perform maintenance, updates, or redesigns
Temporarily interrupt service for fixes, security, or upgrades
Modify, add, or remove features or UI

Routine maintenance/adjustments may occur without prior notice. For major changes or discontinuations, we will, where reasonably feasible, provide notice via site or email.

7.3 Image Storage

Free accounts: Images are retained only short term; we do not guarantee long-term storage and may delete at any time without notice.
Paid accounts: During an active subscription, we will use reasonable efforts to retain generated images but do not promise permanent storage; deletions may occur due to cost, maintenance, or compliance.
Your responsibility: Download and back up any important images. We are not liable for loss or deletion of generated content.

8. Account Termination & Data Deletion

8.1 Your Termination

You may request at any time via account settings or [email protected]:

Cancel subscription (stop future billing)
Delete account (after canceling or expiry)

After cancellation:

You keep paid entitlements for the current billing period
Renewal stops at period end

8.2 Our Termination

We may suspend or terminate your account (often without prior notice) if:

You seriously or repeatedly violate these Terms or law
Fraud, abuse, or security risks exist
Payment/refund disputes arise
We reasonably deem action necessary to protect the Service or users

8.3 Data Deletion

After account deletion (by you or us), we will:

Delete or anonymize associated personal data and generated images within a reasonable time, except records we must keep by law
Retain limited backup copies for disaster recovery or audit; these backups typically are not restored to production

We do not guarantee a one-click export of all historical data. If you need records, download them before deletion. See our Privacy Policy for retention details.

9. Third-Party Services

The Service relies on third parties (e.g., Creem for payments, Google OAuth for auth, Resend for email, Cloudflare R2 for storage).

Your use of these services may be subject to their own terms and privacy policies.
We are not responsible for third-party actions, content, or service quality.

10. Disclaimers & Liability

10.1 Disclaimers

To the maximum extent permitted by law:

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.
We do not guarantee availability, accuracy, completeness, reliability, or suitability.
We do not guarantee AI outputs are non-infringing or provide legal advice regarding your use of outputs.

You use the Service and any generated or downloaded content at your own risk.

10.2 Limitation of Liability

To the maximum extent permitted by law:

We are not liable for indirect, incidental, special, consequential, or punitive damages (including lost profits, data loss, business interruption, or goodwill), even if advised of the possibility.
For any claim related to the Service or these Terms, our total liability is capped at the higher of (a) fees you paid to us for the Service in the 12 months preceding the event, or (b) USD $100.

Some jurisdictions do not allow certain exclusions/limitations; in those cases, these apply only to the extent allowed locally.

Updated Terms will be posted here with a "Last Updated" date.
For material changes, we will, where reasonably feasible, provide notice via site or email.

Continued use after updates take effect means you accept the changes. If you disagree, stop using the Service and cancel/delete your account.

13. General

These Terms plus the Privacy Policy form the entire agreement between you and Chromapeel regarding the Service.
If any provision is held invalid or unenforceable, the rest remain in effect.
Failure or delay to enforce a right is not a waiver.
You may not transfer these Terms without our written consent; we may transfer them within reasonable bounds.
